COMMISSION TERMS OF SERVICE

By commissioning, trading with, or otherwise acquiring artwork from the Artist, the Client agrees to the following terms and conditions. These terms apply to all past, present, and future artwork usage.

I. Definitions of Terms
Personal Use: Using the artwork for personal enjoyment (e.g., social media icons, banners, phone backgrounds, character galleries). It strictly excludes making any money from the artwork.

Commercial Use: Using the artwork to generate profit (e.g., merchandise, branding, logos, streaming assets used for profit, or advertising). This is strictly prohibited without a separate Written Agreement.

Written Agreement: Any mutual agreement made in writing. This does not require a formal legal document; clear, mutually agreed-upon text communication (such as DMs, emails, or messages) serves as official written proof of agreement between the Artist and the Client.

Heavily Referencing: Studying, tracing, or color-picking from the Artist's work to create a new piece of art.

Character Valuation: The monetary worth of a character. When the Artist creates a piece of art for a character, the character's total value increases by the cost of that specific commission tier.

II. Copyright & Ownership
- Artist's Copyright: The Artist retains full copyright to all artwork created. Commissioning the Artist pays strictly for the labor of creating the piece. The Client retains ownership of their original character(s), but not the copyright to the specific artwork produced by the Artist.
- Portfolio Rights: The Artist reserves the right to use any commissioned artwork for portfolio or promotional purposes (such as commission examples). The Artist will typically ask for permission before posting work of the Client's characters and is open to discussing private commissions.
- DMCA Enforcement: The Artist retains the right to file a DMCA takedown claim if the artwork is reposted or used in a way that violates these Terms of Service.
- AI & Blockchain Prohibition: Under no circumstances may any of the Artist’s work be used for machine learning/AI training, fed into generative AI algorithms, or minted as Non-Fungible Tokens (NFTs) or any other blockchain-based asset.
III. Permitted Usage & Crediting
- Personal Use Only: Artwork acquired from the Artist is for personal use only. The artwork may not be used in advertising, as a commercial reference, or sold as merchandise without a separate Written Agreement.
- Standard Crediting: Proper credit must always be provided when reposting the artwork to any platform by tagging the Artist's professional handle (@c4tling).
- Roblox Crediting: For resources created for the Roblox platform (including game assets, 2D clothing, and 3D accessory models), the Artist requires their professional identity to remain strictly separate for platform compliance. Credit must be permanently included in the game or item description citing only the Artist's Roblox username (little_lemonboy). Do not link or mention the Artist's standard social media accounts for Roblox assets.
- Referencing Guidelines: The Client may heavily reference artwork depicting their own characters solely for personal growth, provided explicit credit is given. The Artist's work may never be referenced for commercial work, commissions, gifts, or art trades.
IV. Workflow, Communication, & Deadlines
- Right to Refuse: The Artist reserves the right to decline any commission request, from any individual, for any reason prior to accepting payment.
- Deadlines & Turnaround: If the Client requires the artwork by a specific date, this must be stated upfront. The Artist currently does not accept deadlines shorter than two (2) days.
- Streaming Content: The Artist may stream the drawing process of the commission live. If the Client prefers the process to remain private, they must explicitly state this before work begins.
- Client Ghosting: If the Artist requires approval to continue a piece and the Client fails to respond for more than 14 days, the commission is considered abandoned. The Artist reserves the right to cancel the project with no refund provided, or to consider the commission complete as-is. Leniency may be granted strictly on a case-by-case basis at the Artist's discretion.
- Revisions: Revisions are handled on a case-by-case basis. Minor adjustments during the sketch phase are generally permitted; however, an excessive amount of revisions, or major changes requested after the sketch has been approved, may incur additional fees at the Artist's discretion.
V. Payment, Chargebacks, & Refunds
- Payment Methods & Timing: Payments are accepted via PayPal, Ko-Fi, Venmo, and CashApp. Payment must be provided 100% upfront before any work begins, unless otherwise explicitly agreed upon (e.g., with close friends). Prices for platforms that incur transaction fees (such as Ko-Fi) will be slightly adjusted to cover those costs.
- The Chargeback Clause: Filing an unauthorized chargeback or dispute via PayPal, a bank, or a credit card company will result in the immediate revocation of all rights to the artwork, a permanent blacklist, and a DMCA takedown issued against any platform where the art is posted.
- Dissatisfaction: Dislike of the final artwork is not considered valid grounds for a refund.
- Commissions Under $75: A full refund can be issued if requested before the sketch is completed and lineart has begun. Once the sketch is completed and lineart has started, the Client is only eligible for a 25% to 50% partial refund, depending on completion.
- Commissions Over $100 (Large Projects): Custom refund terms may be discussed mutually prior to starting. If no custom terms are established, the default policy for large projects is as follows: 100% refund if canceled before work begins; a 50% refund if canceled during or immediately after the sketch phase; and no refunds permitted once lineart, 3D modeling, or final rendering has begun.
- WIP Forfeiture: If any refund is issued at any stage, the Client immediately forfeits all personal use rights to any Work in Progress (WIP) images.
VI. Character Valuation & Resale Rights
- Value Appraisals: Artwork created by the Artist adds its equivalent commission value to the character, even if the artwork was acquired for free.
- Resale Limits: Characters designed by the Artist may not be resold for a higher price than they were originally purchased for, unless additional commissioned art is included in the sale. A character obtained for free must remain free, and a character bought for a set price must remain that set price.
VII. Violations, Enforcement, & Exceptions
- Breach of Terms: Failure to comply with these terms will result in the immediate revocation of the Client's personal use rights for all past and present art.
- Malicious Use & Harassment: If the artwork is used maliciously, or if the Client engages in harassment, smear campaigns, or any behavior intended to discredit the Artist, the Client will be immediately blocked, blacklisted, and stripped of all usage rights to the artwork.
- Exceptions: The Artist may occasionally grant explicitly stated permission (such as to close friends) that negates specific terms within this document on a case-by-case basis.
